Article 1. Description of the service

Access to your account must be secured by you through an email address and a password. We strongly advise you not to disclose your password to third parties. Model CV reserves the right to consider all operations conducted within your account, following a request for access using your email address and password, to be under your management and supervision. You are responsible for all operations conducted within your account, except in cases of explicit communication to Model CV of your password being held by a third party. Upon payment, you are authorized to use the service for creating, processing, exporting, and downloading CVs and cover letters. You are responsible for the use of the tools and functionalities offered by the service.

Creating the first version of your CV automatically creates an account. An email informs you of the access data to allow you to identify yourself and use the service's functionalities. Your space allows you to save different versions of your CV, cover letters, and personal data. Your connection to the service allows you to consult them at any time.

Article 2. Conditions of use

We reserve the right to prohibit the use of the service for actions that would contradict the regulations and the application of the law in force. This clause refers, among other things, to the recording or dissemination of information deemed defamatory, containing libelous or racist writings, or sending unwanted messages through the service Model CV.

Each account is personal and can only be managed by the holder of the email address associated with the account. We expressly forbid allowing access to your account by third parties.

In case of a complaint or if Model CV detects an infringement of one or more of the rules mentioned above by you, we reserve the right to close the user account or completely block access to the service, without any refund of the amount paid.

In all cases where Model CV detects a potential problem, damage, or imminent danger to the proper functioning of Model CV or third-party computer systems or networks, and/or the provision of service via the internet, particularly through unsolicited email or data transmission, personal data disclosure, or the spread of computer viruses, Trojans, and similar software, Model CV reserves the right to take all necessary and fair measures to eliminate or prevent the danger.

Model CV CV reserves the right to file a complaint at any time in the event of the detection of criminal acts. Similarly, Model CV eserves the right to disclose the name, address, IP address, and other identification data of any user to third parties who complain and detect a violation of their rights or these general conditions, provided that the complaint is deemed plausible, there are no other means of accessing this data, and the third parties can justify their interest in obtaining the data.

Model CV reserves the right to pass on to the infringing user any damages suffered due to the violation of the above-mentioned conduct rules. The user indemnifies Model CV against all complaints from third parties in the context of the introduction of their transmitted information.

Article 3. Intellectual property

The information published or recorded by the user via the CV creator, Model CV, namely text or identity photo, is and remains the property of the user. Model CV reserves a limited right of use within the framework of processing this information for the provision of the service.

The user can revoke this right of use mentioned in the previous paragraph either by exercising their right to delete the concerned data or by terminating the concluded agreement.

When a user sends information to Model CV , for example, feedback about an error or a suggestion for its correction, they automatically grant Model CV , an unlimited and eternal right of use of this information within the framework of the services provided by Model CV . Model CV is not required to pay compensation if it decides to integrate the user's suggestion or feedback on its website.

The CV creator, Model CV, will not be aware of the confidential data that the user saves or disseminates via the service, except in cases of absolute necessity within the framework of the proper execution of the service, or if Model CV is required to do so by any legal provision or judicial obligation. Model CV will take all necessary measures to limit the transmission of data as much as possible within its capabilities.

The user has the right to use the service and the documents generated through this service, such as a CV or cover letter, for the duration of their membership. At the end of their membership period, the user is no longer authorized to use the generated cover letters and/or CV layouts. These documents can only be used by the user after financially acquiring the rights from Model CV that are based on these documents.

The service, websites, related software, and all information, illustrations of the website(s), CV templates/layout, and cover letters are an integral part of the intellectual property of Model CV . The elements mentioned above may not be copied or used without the explicit written permission of Model CV , except in all cases authorized by law.

Similarly, the layout of the final document that the user can download through the service is part of Model CV , intellectual property under the previous paragraph. The user receives a limited right of use of this layout. No express authorization will be issued for use other than the service, except for combined use with documents written and offered by the service Model CV. This right will persist even after the closure of this agreement, including the related conditions.

Article 4. Site availability

Model CV takes all necessary measures to ensure the availability of the service but cannot guarantee 100% availability.

Model CV actively maintains the proposed services. Maintenance can occur at any time, announced or unexpectedly, even if it may cause limited availability.

Model CV reserves the right to modify the service at any time, appreciates user feedback, but reserves the right to personally determine the information to be disclosed on the website.

Article 5. Service pricing conditions

The use of the service automatically implies a financial payment to Model CV . The current tariff is indicated on the website depending on the product.

Depending on where you make your transaction, the payment method used, and the place of issuance, foreign currency conversion fees may apply, and price differences may be observed due to exchange rates. Your transaction may be subject to foreign currency conversion fees assessed by your bank or card issuer. Model CV is not responsible for foreign currency conversion fees or additional taxes, and will not pay any compensation or refund for charges imposed by your bank or card issuer.

The costs related to the use of the service must be paid in advance, upon the introduction of the service usage request.

The initial use of the CV creator, Model CV, automatically implies the obligation to subscribe to a membership. The user's subscription implies the obligation to pay a monthly fee. The amount due by the user will be subject to a monthly advance payment from the end of the first month of subscription

Model CV reserves the right to modify the costs notified in Article 5 at any time. Model CV guarantees to communicate any price change to the user within one (1) month before the price change takes effect. In case of user disagreement with the price change, they have the right to terminate the concluded agreement until the implementation of the updated prices.

Given the immediate execution of the service byModel CV , expressly requested by the user, no payment claim or recourse to the articles of the Distance Selling Law will be allowed to the user.

Article 6. Payment terms

The user can make the payment by credit card following the instructions described on the website.

In case of non-payment by the due date, Model CV sends a payment reminder inviting the user to settle the due amount within 14 days. If the user does not fulfill their payment obligation within the stipulated period of the reminder, they are considered in default without any additional notice. Therefore, Model CV reserves the right to claim reminder costs and limit its service provision, for example, by limiting access to Model CV.

If Model CV annot collect the due amount and/or if the user does not pay by the due date, the user will not only owe the due amount plus related interest but also full compensation for extrajudicial collection costs.

Article 7. Duration and Termination of Subscription

This agreement and the user's subscription take effect from the first use of the service by the user, as mentioned in Article 1 of these general conditions.

The user can terminate the subscription at any time through their account or by contacting customer service. To avoid undesirable subscription renewal, the user must terminate the subscription in their account no later than the day before the new subscription period.

In case of subscription termination, no advance payment received by Model CV will be refunded to the user.

The data saved by the user will be deleted eighteen months after the last date of service use. Model CV commits to informing the user by email before the data deletion, but no obligation binds it. However, the user will have the possibility to use the data until their deletion by opting for a new agreement conclusion.

Article 8: Right of withdrawal

In accordance with the law, the Customer has a period of fourteen (14) days from the conclusion of the contract for the provision of services to exercise his right of withdrawal without having to provide a reason.

3. Effects of withdrawal

In the event of withdrawal, "model-cv.com" will reimburse all payments received, free of charge, within a maximum period of fourteen (14) days following notification of withdrawal, using the same means of payment as that used by the Customer.

4. Exception to the right of withdrawal

The right of withdrawal does not apply if the service has been fully executed before the end of the 14-day period, with the customer's prior consent.

Article 9. Modifications des prix et des conditions

Model CV reserves the right to modify these conditions and prices, effective at the beginning of each new payment period, except as otherwise provided by law.

Model CV Model CV commits to announcing changes or additions on the website at least thirty days before the effective date, allowing the user to become aware of them within an acceptable period.

If the user does not accept the change or addition, they will have the possibility to terminate this agreement until the effective date of the change or addition. Using the service after the effective date of the changes or additions signifies the user's formal acceptance of the modified or additional conditions.

Article 10. Responsabilité

Unless otherwise provided by law, the following liability provisions prevail when using the service.

Except in cases of intentional fault or gross negligence, Model CV 's liability is limited to the reimbursement of the amount paid by the user for the two (2) months preceding the event that may have caused possible damages.

Model CV cannot be held liable for indirect damages, consequential damages, loss of profits, missed jobs, unrealized savings, and damages due to business stagnation.

In case of force majeure, Model CV will never be obliged to refund the damages suffered by the user due to the events mentioned above. Force majeure events include, but are not limited to, those typically recognized by case law: malfunction and failure of the internet network or telecommunications infrastructure, malfunction or interruptions of the electrical network, internal rebellions, mobilization, war, blocking of means of transport, strike, lockout, business activity disturbances, supply stagnation, fires, floods, and all other events beyond the express will of the parties preventing the normal execution of the service usage and provision.

Article 11. Dispositions diverses

This agreement is governed by and must be interpreted in accordance with French law.

Within the limits not otherwise prescribed by mandatory law, any dispute arising within the framework of this agreement with Model CV will be submitted to the competent French jurisdiction in the district where Model CV has its Head Office.

In cases where a provision of these terms of use requires written communication, it will be deemed respected if the communication has been transmitted by email or through Model CV , provided it is clear that the message originates from the sender and that the integrity of the message has not been altered.

Model CV may transfer its rights and obligations under this agreement, as well as personal data recorded and processed during its service provision, to a third party acquiring Model CV or its business operations.
